Three voters in Hulu Selangor have filed for judicial review in the Kuala Lumpur High Court seeking to quash the Election Commission's (EC) exercise in altering the constituency boundary that they claim have affected them.

They are asking the court to declare that EC's nationwide locality correction exercise, which was gazetted on April 29 and caused a huge number of voters being shifted out their previous polling station, as unconstitutional and illegal.

The applicants - P. Maradeveran (59), Zahar Rusuli (49) and Yong Chan Hee (36) - claimed to have been affected by the delineation exercise, which also involved Kuala Kubu Bahru (KKB) state seat and its adjacent state constituency - Batang Kali.

Maradeveran and Zahar who voted in the Batang Kali state seats in the previous polls, were not happy about being transferred to KKB.

Meanwhile, Yong complained about the drastic increment of 5,590 new voters from 14 localities in Batang Kali into her KKB state seat.

The action resulted in an increase of voters from 21,186 to 26,720 in KKB.

Their civil action filed on Oct 19 was assisted by DAP. The court has fixed Nov 9 for case management.

Both EC and its assistant secretary were named as respondents.

At the press conference called by DAP, Serdang parliamentarian Ong Kian Ming said the applicants wanted the court to rule that EC had acted ultra vires of Section 7 of the Election Act and Articles 113 and 117 of the Federal Constitution.

"The alteration of boundaries can only be conducted under the (Sept 15) proposed redelineation exercise," he said.

EC had stated that there were no boundary changes in the latest redelineation exercise involving Kuala Kubu Bahru, he said.

"My suspicion is that EC will reject the objection using the reason that there were no boundary changes to Kuala Kubu Bahru and Batang Kali," he said.

"So, we are left with no choice but to file a judicial review on behalf of some of the affected voters," he said.

Also present were DAP publicity secretary Tony Pua and KKB state assemblyperson Lee Kee Hiong.
