The High Court in Kuala Lumpur has fixed Jan 17 to hear Petaling Jaya Utara MP Tony Pua’s application to strike out a suit filed by Prime Minister Najib Abdul Razak.

Judicial Commissioner Roslan Abu Bakar fixed the date after meeting the parties during case management this morning.

Pua’s lawyer Aliff Benjamin Suhaimi said the hearing will be at 3pm on that day.

"There is also no indication by Najib whether he would be appealing the Court of Appeal's decision earlier this week to reinstate portions of Pua's defence," Aliff said.

Najib has 30 days to file an appeal.

On Monday, the Court of Appeal allowed Pua's application to reinstate two paragraphs of his defence, thereby overturning the decision of the High Court to expunge the paragraphs and exhibits.

Najib had sued Pua and Media rakyat owner Chan Chee Kong over a video put up on YouTube, in which the DAP national publicity secretary accuses the PM of stealing money and that he would continue to steal money from 1MDB.

Najib filed the suit on March 5 last year, in his personal capacity.

One of the paragraphs is on 1MDB's corporate structure, and is backed by documents obtained from the Companies Commission of Malaysia and printouts from 1MDB's website,

The other is on Pua's affirmation that the 1MDB issue is an issue that has been reported in mass media and is therefore a matter of public interest.

He backed this claim with news articles on the issue.

While Najib has filed various suits against the opposition and also against former MCA president Dr Ling Liong Sik, none of his suits have seen any hearing dates fixed for him to testify.
