The High Court in Shah Alam today allowed the government's application to strike out the RM100 million suit filed by the family of Mongolian national Altantuya Shaariibuu over her death.

The suit was filed in 2007 by Altantuya's father Shaariibuu Setev and her two children, Mungunshagai Bayarjargal and Altanshagai Munkhtulga.

The order was made by Justice Ahmad Nasfy Yassin on the grounds that the suit did not disclose a reasonable cause of action.

The family's lawyer Ramkarpal Singh in a statement today described the decision as disappointing and has indicated that an appeal will be filed at the Court of Appeal.

“It should be noted that the plaintiffs' suit against Azilah Hadri, Sirul Azhar Umar and political analyst Abdul Razak Baginda remains unaffected by this decision and will proceed after the disposal of the said appeal (against the government).

“We will proceed to file an appeal against the said decision to the Court of Appeal on behalf of Altantuya's family, while we respect the High Court's decision," he added.

The suit which was filed 10 years ago only proceeded after Azilah and Sirul were found guilty by the Federal Court, after it allowed the prosecution's appeal on Jan 13, 2015, and sentenced the duo to death by hanging.

Sirul, however, fled to Australia before the verdict was delivered. He was arrested by the Australian authorities and still remains at the Villawood Immigration Detention Centre in Sydney.

Australia said it would not approve any request to extradite him unless Malaysian authorities guarantee he would not face execution.

Following the end of the criminal case, Ramkarpal amended the statement of claim to include Azilah and Sirul's conviction and they managed to serve the documents through a private server to Sirul only last year.
