Carpet dealer Deepak Jaikishian informed the Kuala Lumpur High Court today that he intends file third-party claims for indemnity or contribution against former prime minister Najib Abdul Razak, wife Rosmah Mansor and six others.

This follows the Court of Appeal allowing Najib, Rosmah, lawyer Cecil Abraham and his son Sunil, lawyer M Arulampalam and commissioner of oaths Zainal Abidin Muhayat to strike out the suit filed by A Santamil Selvi and her three children.

Santamil, the widow of private investigator P Balasubramaniam, had filed for damages for loss of income and injury after being forced into exile in India for nearly five years in relation to the murder of Mongolian national Altantuya Shaariibuu.

She is also suing Deepak, who previously withdrew his striking out application.

Today, lawyers for Deepak and Santamil, RK Nathan and Americk Sidhu, met Justice Hue Siew Khong in chambers.

Cannot run away any longer

Deepak later told reporters that it is vital for Najib, Rosmah and the other defendants to be brought to court. "This is what is stated in my statement of defence," he said.

The businessperson stressed that the eight defendants cannot run away any longer, after providing various excuses over the years, and that he will not face the consequences alone if the court finds him liable.

Balasubramaniam and his family were exiled from July 2008 to February 2013, following his statutory declaration acknowledging that Najib knew Altantuya.

Before going into exile, the late private investigator made a second statutory declaration denying the first.

Najib continues to deny ever knowing Altantuya.

Americk, meanwhile, confirmed that his client will appeal the striking out of her suit against the eight defendants at the Federal Court.

He said Hue has fixed Sept 28 for case management.
