The High Court fixed Oct 25 to hear Najib Abdul Razak’s judicial review to oust former federal court judge Gopal Sri Ram from leading the prosecution in the former prime minister’s RM2.28 billion 1MDB trial.
That date was also set for the hearing of Muhammad Shafee Abdullah’s judicial review to remove Sri Ram from leading the prosecution in Shafee’s ongoing criminal case.
This was confirmed by lawyer Muhammad Farhan Muhammad Shafee after he attended case management on the matter in the chambers of High Court judge Mariana Yahya in Kuala Lumpur today.
“The hearing of the judicial review proper has been set for 3pm on Oct 25,” Farhan told journalists after the proceedings.
He added that they had also informed the court that they have served the cause papers on the three respondents in the matter, namely the Attorney-General/Prosecutor of Malaysia (Peguam Negara/Pendakwaraya Malaysia), the government of Malaysia and Sri Ram.
On Aug 26, the Court of Appeal granted leave to both Najib and Shafee to proceed with their judicial review applications.
The apex court decision in effect overturned an earlier High Court ruling on Feb 20 that denied leave to the duo to proceed with their judicial review.
The Court of Appeal ruling is in regard to Najib's and Shafee’s civil-jurisdiction judicial review applications, which are distinct from Najib’s similar application at the criminal-jurisdiction level.
On Aug 7, a Federal Court bench led by Chief Justice Tengku Maimun Tuan Mat dismissed an appeal by Najib in regard to his criminal-jurisdiction level bid to disqualify Sri Ram from leading the prosecuting team in the 1MDB case against Najib, among others.
Meanwhile, Farhan (above) said that in the chambers, federal counsel Aisyaf Falina Abdullah informed the parties that the three respondents intended to file an appeal in the Federal Court against the Aug 26 Court of Appeal ruling.
Aisyaf represented the three respondents in today’s case management.
“In today’s case management before Justice Mariana, we were informed by the federal counsel (Aisyaf) that they (the three respondents) intend to file an appeal in the Federal Court against the (Court of Appeal) ruling that allowed us (Najib and Shafee) to proceed with the judicial review.
“As it stands, the application (by the three respondents for leave to appeal) has not been filed before the Federal Court.
“However as far as the High Court is concerned, this matter will still proceed (on Oct 25),” Farhan said.
On whether the three respondents intended to file an application with the Federal Court for a stay of the entire judicial review proceedings, pending the disposal of the appeal, the lawyer said he has not heard anything about it so far.
