The Indian Hindu woman who was told to seek legal redress from the Syariah Court has been granted an interim injunction restraining her Muslim-convert husband from pursuing his claims in the Islamic court.

Malik Imtiaz Sarwar, one of her counsel, told malaysiakini that R Subashini, 28, obtained the interim injunction from the Court of Appeal in Putrajaya this morning.

"The injunction restrains her husband Muhammad Shafi Saravanan Abdullah from converting their second child and from pursuing his claims in the Syariah Court," he said when contacted.

He added that the majority decision for the injunction was granted by appellate court justices Gopal Sri Ram and Hassan, while Suriyadi dissented.

Muhammad Shafi is currently seeking the custody of their two children - aged three and one - and a decree of divorce from Subashini in the Syariah Court.

On March 13, the appellate court dismissed Subashini's attempt to stop her recently converted husband Muhammad Shafi from bringing divorce proceedings to the Syariah Court.

She was told by justices Suriyadi Halim Omar and Hassan Lah who made the majority 2-1 decision to take her case before the Syariah Court instead. Gopal Sri Ram dissented.

Landmark ruling

It was also held in the landmark ruling that a Muslim could apply to the Islamic court to convert his or her underaged children without permission from the non-Muslim spouse.

Malik said the restraining order was pending the disposal of the application of leave from the Federal Court which was filed today.

"This mean the husband can't do anything in the Syariah Court until the Federal Court fixes a date for the hearing," he explained.

Also representing Subashini in court today were Haris Ibrahim and K Shanmuga.
