Two weeks ago, five officers from Jabatan Agama Islam Selangor (Jais) came to his house in Klang.

They told the 25-year-old lorry driver that his wife is a Muslim and therefore their year old Hindu marriage was void.

Arguing the matter further would result in him being charged for khalwat, they warned. Magendran Sabathy relented.

Since then, he has not heard from his wife.

"She didn't know anything. Jais should have followed the law," he told a press conference in Parliament.

His wife's identity card states her name as Najeera Farvinli Mohamed Jalali. Muslims are forbidden from co-habiting prior to marriage.

Meanwhile, DAP national chairperson Karpal Singh told reporters that a notice of motion has been sent to the Shah Alam High Court for Magendran to be reunited with his wife, who is believed to be under Jais' custody.

The opposition leader also distributed photographs of the couple's Hindu wedding ceremony to reporters.

In March, Jais had taken away five children of rubber tapper P Marimuthu after claiming that his wife was a Muslim.

Custody battle

Meanwhile, Karpal also told reporters that a custody battle is taking place between a hair stylist and his newly converted wife.

In an ex-parte decision on May 3, the syariah court gave S Gopal Subramaniam's wife temporary custody of their two children aged one and five.

His wife Audrey Christina Samuel, who converted to Islam and changed her name to Nur Adrayana Qestina Abdullah last month, claims to have converted their children as well.

According to Karpal, Gopal, who was also present at the press conference, wants to contest the case in the civil court.

"I cannot accept this. I'm angry. You [Nur Adrayana] are matured and the children don't know anything," said the upset father.

Karpal said the matter would be argued under Clause 4 of Article 12 of the Federal Constitution, whereby the religion of a person under the age of 18 is decided by his/her parent or guardian.

"Furthermore, the constitution, organisation and procedure of Syariah courts have only jurisdiction over persons professing the religion of Islam," he said, adding that a temporary injunction will be filed over the matter.
