The Court of Appeal (criminal jurisdiction) has allowed Rosmah Mansor’s application to postpone next week’s initially scheduled hearing of her appeal to quash her conviction and sentencing in a graft case linked to the RM1.25 billion solar hybrid energy project.

A three-person bench chaired by Azizah Nawawi this morning greenlighted the bid by the wife of incarcerated former prime minister Najib Abdul Razak for postponement of the criminal appeal set for July 11, pending disposal of her separate appeal before the Federal Court.

Before the Federal Court, Rosmah (above) has a pending appeal to obtain civil court greenlight to challenge the validity of the entire corruption case against her, on grounds of the alleged invalid appointment of the late apex court judge Gopal Sri Ram as lead prosecutor in the graft case.

During today’s Court of Appeal proceedings, counsel Jagjit Singh submitted that the postponement was sought in good faith with no intent to delay the criminal appeal, pointing out that the civil appeal need to be disposed of first.

Deputy public prosecutor K Mangai informed the bench that they have no instructions to object to the adjournment bid.

No objection

Azizah then allowed the adjournment in a unanimous decision, with the other members of the criminal appellate bench comprising judges Ahmad Zaidi Ibrahim and SM Komathy Suppiah.

"The challenge (pending as the civil appeal before the apex court) is on the letter of appointment to nullify the criminal (case).

"As the PP (public prosecutor) has no objection, we inclined to allow the adjournment," Azizah said.

Rosmah's criminal appeal before the Court of Appeal is set for further mention on Sept 18.

On Sept 1 last year, the High Court (criminal jurisdiction) in Kuala Lumpur convicted her in the graft case involving the project for 369 rural schools in Sarawak, and sentenced her to 10 years of imprisonment and RM970 million fine.

However, she obtained a stay of execution against the sentencing, pending disposal of her appeal before the Court of Appeal.
