The court rejecting an application to postpone the Nenggiri by-election proves Bersatu’s constitution was amended properly, said party secretary-general Hamzah Zainudin.

He said this shows alleged errors in the process of amending the party’s constitution were completely unfounded.

Even the Registrar of Societies (ROS) confirmed the process of applying for the party’s constitutional amendments was conducted in an orderly manner, he said, through a letter dated June 19.

“God willing, this positive development will be a catalyst for Bersatu’s success, and is surely linked to the systematic and orderly handling of the party’s administrative affairs.

“Hence, for everyone’s information, especially to party members, it is once again emphasised that the process and procedure of amending Bersatu's constitution was done diligently in accordance with constitutional requirements,” Hamzah said in a statement today.

Yesterday, the Kuala Lumpur High Court rejected former Nenggiri assemblyperson Mohd Azizi Abu Naim’s application for an interim injunction to postpone the announcement of the by-election date for the Nenggiri state seat.

This is pending the court’s decision on his lawsuit challenging the validity of the termination of his party membership, which led to the vacancy of the seat.

On April 2, the ROS reportedly approved amendments to Article 10 of Bersatu’s constitution concerning the resignation and dismissal of party members.

Among other things, it invalidates the membership of any member who supports parties opposing Bersatu.

The amendments were made after six of the party’s MPs shifted their support to the federal government.

Apart from Azizi, who is also the Gua Musang MP, the other six who did so were Syed Abu Hussin Hafiz Syed Abdul Fasal (Bukit Gantang), Zahari Kechik (Jeli), Iskandar Dzulkarnain Abdul Khalid (Kuala Kangsar), Suhaili Abdul Rahman (Labuan), and Dr Zulkafperi Hanafi (Tanjong Karang).
