Muhyiddin's SDs had clause that voids pre-GE15 agreements: Bersatu

The statutory declarations signed by lawmakers backing Perikatan Nasional chairperson Muhyiddin Yassin to be the prime minister after the 15th general election had a clause that voids any agreement before the polls, says Bersatu.

In a statement today, the party’s information chief Razali Idris said that the legitimacy of the SDs was unquestionable regardless of what was signed by the lawmakers before they contested in GE15.

Razali was responding to Umno president Ahmad Zahid Hamidi, who questioned the SDs’ legitimacy.

“Zahid is wrong. Why? Because the SDs signed by all MPs supporting Muhyiddin contained a clause that stated all documents signed previously related to the formation of the government after GE15 are null and void.

“This means that all 115 SDs submitted by PN to the Istana Negara at 1.28pm on Nov 21, 2022, are valid,” he said.

Previously, Zahid said that PN only has 105 lawmakers backing Muhyiddin as the prime minister after GE15 since the 10 SDs from BN are illegitimate.

Before the election, BN candidates had an agreement that they would move en bloc, making Zahid the sole authority deciding the coalition’s trajectory after the polls.

‘Anwar did not have the numbers’

Further denying this, Razali said that he is confident that Pakatan Harapan chairperson Anwar Ibrahim did not have the majority support to dispute Muhyiddin’s SDs.

“Did Anwar have more than 112 SDs at that time to be appointed PM? I think not.

“Why? Because if Anwar had more than 112 SDs before 2pm on Nov 21, 2022, the time set by Istana Negara for SD submission, he would certainly have rushed to Istana Negara to take the oath,” he added.

Yesterday, Razali launched a blistering counter to those who have challenged Muhyiddin to reveal the names of the lawmakers who supported him to become prime minister after GE15.

He trained his guns on Umno supreme council member Mohd Puad Zakarshi and former Sabah chief minister Salleh Said Keruak, claiming that the duo knew the identities of the BN MPs who backed Muhyiddin.

Razali also claimed that the lawmakers were subjected to threats and they will have to testify in court if Muhyiddin is charged for allegedly insulting the previous Yang di-Pertuan Agong over the appointment of the prime minister following GE15.

Muhyddin claims 115 MPs’ support

In a speech during the Nenggiri by-election campaign, Muhyddin claimed that he had the required support to form the government after GE15 but was not called to be sworn in as the prime minister by the then Agong, Sultan Abdullah Sultan Ahmad Shah.

To facilitate a police investigation into his speech, the PN chief submitted 115 SDs - including his own - that were purportedly from lawmakers who supported him to be the prime minister amid the post-GE15 political deadlock.

He also submitted a letter from the private secretary to Sultan Abdullah affirming that he had received the declarations on Nov 21, 2022. 

Muhyiddin said he had attached to his document 51 SDs from PN, PAS (22), Gabungan Parti Sarawak (22), Gabungan Rakyat Sabah (six), Parti Kesejahteraan Demokratik Malaysia (one), as well as SDs from 10 BN MPs and two independent MPs. 

The SDs from PN and PAS MPs were separate as PN had contested using the PAS logo in Terengganu and Kelantan.
