Ousted Perak menteri besar Mohd Nizar Jamaluddin reaffirmed today that he would never give up the fight to win over Perak from the BN.

"We are not giving up and we have not given up .There is nothing to show that we have,” he declared.

Nizar appeared at the Jalan Duta Court Complex in Kuala Lumpur at 11.20 this morning alongside his panel of lawyers and senior Perak Pakatan leaders to file a challenge on the appointment of Perak's new BN Menteri Besar Zambry Abdul Kadir.

Some 300 people including opposition parliamentarians and supporters gathered outside the court in support of Nizar.

Several supporters were spotted wearing black arm band, usually worn when in mourning, to show support and solidarity to Nizar and his government colleagues.

They shouted Hidup Rakyat and Makkal Sakthi three times.

Led by a team of lawyers, including Leong Cheok Keng and Nga Hock Cheh, Nizar filed the suit, listing Zambry as the only respondent.

He also offered a short prayer after the application was filed in the Special Powers and Appellate registrar at 11.35am.

At a press conference later, the ousted MB explained that the writ for a judicial review was filed in accordance with Section 16(6) of the Perak Constitution which states that the position of the mentri besar can only be stripped off or vacated if the mentri besar was to resign voluntarily."

Besides that, the dissolution of the state assembly or a motion of no confidence are the other legitimate ways to go, he added.

"We demand for a declaration that the government formed by the BN is an illegitimate government," said the Pakatan leader.

Nizar who is also Pasir Pajang state assemblyperson said that Pakatan would be appealing to the Perak Sultan to dissolve the assembly and call for snap elections in all 59 state seats.

Also present in court today were parliamentarians Kamarul Baharin Abbas (Teluk Kemang), Charles Santiago (Klang), Khalid Samad (Shah Alam) and Dr Lo' Lo Ghazali (Titiwangsa) as well as M Manogaran (Teluk Intan), Lim Lip Eng (Segambut), Tony Pua (Petaling Jaya Selatan) and S Manikavasagam (Kapar).

"The truth has come and falsehood has vanished, verily by nature, falsehood will vanish and destroyed in no time," uttered Nizar, citing a passage from the Quran.

The judicial review writ application is also supported by two affidavits from himself and Pakatan Perak Speaker V Sivakumar, confirming the resignation of state assembly representatives Jamaluddin Mohd Radzi (Behrang), Osman Jailu (Changkat Jering) and Hee Yit Foong (Jelapang).

Nizar said he and his councillors will continue with their official duties as usual.
