Although Bersih 2.0 has compromised to accept the government’s offer to hold the rally in a stadium, the police have refused to entertain its demand to release the six Parti Sosialis Malaysia (PSM) activists detained under the Emergency Ordinance (EO).

“Since the very beginning of the arrest of the six, we have obtained concrete reasons that their activities tend to threaten public order.

NONE “Therefore we will not entertain the demand,” said deputy inspector-general of police Khalid Abu Bakar ( left ) during a press conference held at Bukit Aman federal police headquarters.

He told media that until last night, police had arrested 235 individuals related to Bersih 2.0.

Out of this number, 29 of them had been charged under either Section 47 of the Societies Act or Section 29(1) of the Internal Security Act, six PSM activists are still under detention while the others had been released on bail.

Khalid said the police are still receiving reports against the rally.

“Until last night, a total of 3,256 reports have been lodged,” he said.

The PSM 6 are Sungai Siput MP Dr Michael Jeyakumar Devaraj, M Sarasvathy, M Sukumaran, A Letchumanan, Choo Chon Kai and R Sarat Babu.

Their lawyers had filed a habeas corpus application in the Kuala Lumpur High Court registry today to seek their release.

The six were first detained on June 25 at the Sungai Dua toll plaza in Kepala Batas, Penang, for allegedly attempting to ‘wage war’ against the Yang di-Pertuan Agong.

When their remand order expired last Saturday, they were re-arrested under Section 2 (1) of the EO, and had been without access to family or legal assistance.

Under the EO, the police have the power to hold detainees for 60 days to prevent any person from acting in a manner “prejudicial to public order”, or to suppress violence or crimes involving violence.

After the initial detention period, the home minister can authorise the extension of detention without trial for up to two years.
