The High Court today struck out a suit brought by PAS deputy president Mohamad Sabu against Utusan Melayu (Malaysia) Berhad over the publication of an article on the communist terrorist attack on the Bukit Kepong police station.     

Judge Datuk John Louis O’Hara had allowed the application to strike out the suit filed by Utusan Group editor-in-chief Abdul Aziz Ishak and Utusan Melayu.

He ruled that the suit filed by the plaintiff, Mohamad, was plain and an obvious case to be struck out with the absence of endorsement of sufficient statement of particulars of the publication in the suit.

NONE He said Mohamad, better known as Mat Sabu, should have provided sufficient particulars of the publication in his suit, which was required under the law.   

Therefore, he said, the suit had been rendered vexatious, frivolous, scandalous and an abuse of the court process. The judge struck out the suit with RM5,000 costs.  

Mohamad, 57, filed the suit on Sept 14, claiming that the two defendants had maliciously published an article on Aug 27 and two more articles the following day, which he said contained defamatory elements.

He claimed that the three articles were related to the issue over the communist terrorist attack on the Bukit Kepong police station in Johor.

mingguan malaysia 280811 mat sabu dikecam Mohamad claimed that the publication of the articles had indirectly showed that he was a communist supporter, had deviated from the Islamic teachings and faith for supporting communists, and had branded Muhammad Indera as a communist terrorist.

Following the publication of the articles, Mohamad said, he felt ashamed and ridiculed, and his integrity, credibility and reputation were also adversely affected.

He had sought general, exemplary and aggravated damages as well as a court order for the defendants to apologise and withdraw the alleged defamatory articles.
