The Home Ministry is to seek the advice of the attorney-general on whether or not to appeal a High Court decision today quashing an order of the minister declaring Bersih 2.0 an unlawful society.  

Minister Hishammuddin Hussein said in a statement that the ministry would scrutinise the grounds of the judgment.

“I respect the decision of the court which quashed the home minister’s order of July 1 last year which declared Bersih 2.0 an unlawful society,” he said.

Judge Rohana Yusof, in her decision, allowed the petition by 14 members of the Bersih 2.0 steering committee, including S Ambiga, to quash the minister’s order on the basis that Bersih 2.0 comprised a coalition of registered organisations.  

In her 30-page judgment, Rohana ruled that the decision to declare Bersih 2.0 unlawful was made without taking into account some relevant facts or by taking into account some irrelevant facts.
