Gerakan Youth has threatened to initiate legal action against PAS if the party pushes ahead with its plan to move a private member's bill in Parliament to implement Hudud law in Kelantan.

 

Gerakan Youth chief Tan Keng Liang with 12 of the movement's members sent a notice of possible legal action to PAS' headquarters in Kuala Lumpur at 11.45am today.

 

"We have given a notice to PAS that we will take legal action at the courts to preserve our constitution if PAS implements hudud in Kelantan," he said during a press conference at PAS headquarters.

The notice by Gerakan Youth was accepted by PAS Youth's assistant secretary, Yusafiza Yaakob in good spirit, while the opposition party also accorded Tan and his entourage space at the headquarters to conduct a press conference.

In addition, Tan said that Gerakan Youth will gather advise from a committee which will explore options regarding the matter.

Tan said that the committee consists of several legal experts from Gerakan, including himself.

The three other lawyers who are involved in the committee include Gerakan Youth Legal Bureau chief Chai Ko Ting, Gerakan National Legal Bureau chief Baljit Singh and Gerakan Youth deputy chief Andy Yeong.

“The committee will explore actions that we can take. After gathering advise we will act,” he said.

Chai meanwhile opined that the matter could be brought straight to the Federal Court if PAS is still insistent with their move.

“This involves the constitution so it would be brought straight to the Federal Court. There is no need for a Court of Appeal hearing in a constitutional issue that involves public interest,” he said.

The Kelantan state government is expected to table the Private Member’s Bill when Parliament reconvenes sometime in June.

The state government said that it has prepared a draft to be tabled in Parliament that just needs minor improvements.
