Gerakan has mounted a legal challenge against the Kelantan Syariah Criminal Code II 1993 Amendment Bill as it is tabled in the state assembly.

The team led by Gerakan deputy youth chief Andy Yong filed the Originating Summons against the Kelantan state with the Kota Bharu High Court this morning to declare the syariah penal code unconstitutional.  

“Gerakan is firmly against the implementation of hudud in Kelantan or any other parts in Malaysia and we seek legal injunction to declare the Bill is unconstitutional and therefore void,” Yong (below) said.

Gerakan is merely safeguaring the federal constitution and seeks support from all Malaysians in response to the "hudud crisis", he said in a statement.

In a separate statement, the party's youth chief Tan Keng Liang said Gerakan had sent a notice to PAS in April to warn them that a legal challenge will be mounted if they try to implement hudud.

"Ample time had been given to them to reconsider their decision," he said.

Tan also called on DAP's supremo Lim Kit Siang and his son Guan Eng to quit over their failure to stop the tabling of Hudud laws.

While noting that DAP has cut its ties with PAS, he claimed that it was only a political drama.

 

“Malaysians have seen in the past that DAP will continue to partner PAS even after severing ties.

"This can be seen from their partnership in Barisan Alternatif which was disbanded after the 2004 general election.

 

“Again this is seen in Pakatan Rakyat since 2008. Both Barisan Alternatif and Pakatan are merely partnerships of convenience to hoodwink voters,” Tan (left) added.

 

The Kelantan state government  tabled the amendments in the state assembly this morning.

 

This was a re-submission of the entire enactment with five key changes.
