Shaariibuu Setev, the father of murdered Mongolian woman Altantuya Shaariibuu, has to include more documents in the RM100 million suit he filed in 2007 against one of the five parties he named - Corporal Sirul Azhar Umar.

The High Court in Shah Alam today directed the lawyer for Shaariibuu, Ramkarpal Singh, to submit the necessary documents with the amended statement of claim to the court by Tuesday, so that these could be sent to the former police commando in Australia.

Judge Suraya Othman reminded Ramkarpal that certain procedures have to be followed because before the documents could be handed to the Malaysian Consulate in Sydney.

"You have to make an application via Form 10 from the Ministry of Foreign Affairs, which is to be submitted through the deputy registrar here.

"As the Malaysian court does not have formal court ties with Australia, this procedure of sending legal documents has to be followed," Justice Suraya said, adding that Shaariibuu would have to bear the costs of having the consular hand over the documents.

The judge explained that due to ties with Singapore courts, the documents can be handed from court to court.

She said the court would then hand the documents to the Foreign Ministry, for it to be given to the Malaysian consulate in Sydney for the papers to be served on Sirul there.

Lawyer told to file certificate of urgency

Sirul, who was found guilty of murdering Altantuya by the Federal Court on Jan 13, is being detained at the Villawood Immigration detention centre in New South Wales, Australia.

The other co-accused convicted, Chief‎ Inspector Azilah Hadri, is in the Kajang Prison. Azilah and Sirul have been sentenced to death by hanging for the murder of Altantuya.

Following this, Ramkarpal ( photo ) gave his undertaking to‎ hand over the necessary documents, along with Form 10, to the court registry.

Justice Suraya  instructed Ram Karpal to file a certificate of urgency on this, as the hearing on the amended statement of claim has been fixed for July 7.

She also allowed an application by ‎lawyer Hazman Ahmad to discharge himself from representing Azilah in the suit by Shaariibuu.

The judge ordered that a seal copy of the discharge be sent to Azilah in prison and said it would be up to the chief inspector to hire a lawyer.

No instructions from Azilah to lawyer

Lawyer Nadirah Izyan Azaddin, who is from Hazman's firm, told the court that they have sent a letter dated June 4 to Azilah informing their intention to withdraw from representing him as there were no instructions given.

“Azilah did not respond to our letter till today,” she said.

It was previously reported that Hazman had told the court that he was withdrawing himself from representing Azilah in the civil suit but will continue to represent him in the criminal matter.

Hazman was also quoted to have said that Azilah wants to file a review of the Federal Court decision which found him guilty.

Sirul is not represented in the suit, resulting in Ram Karpal having to make the application to send the documents to him in Australia.

Sirul fled to Australia before the Federal Court judgment of Jan 13 and was arrested by the Australian authorities on Jan 21, after ‎a red notice was issued by Interpol following the verdict.
