The Ipoh High Court today ruled in favour of the Perak state secretary Abdul Rahman Hashim by striking out a suit filed against him by ousted Pakatan Rakyat speaker V Sivakumar.

Rahman had applied to strike out Sivakumar's writ of summons under Order 18 Rule 19 of the Rules of the High Court.

Judicial Commissioner Tarmizi Abdul Rahman allowed the application with costs, citing that the plaintiff (Sivakumar) was no longer the assembly speaker and as such had no locus standi .

Another reason given for the ruling was that the Government Procedure Act does not permit any injunction to be granted against the government.

These details were revealed to Malaysiakini by Sivakumar's lawyer Cheang Lek Choy when contacted in the evening.

Sivakumar claimed Rahman ‘interfered'

The application was heard in chambers and the decision was handed down at about 3.30pm.

NONE Sivakumar had filed the civil suit against Rahman, accusing him of interfering in the matters of the Perak legislature, as well as preventing the plaintiff and Pakatan elected reps from entering and holding the assembly meeting at the assembly hall situated in the state secretariat.

Sivakumar had also stated that the defendant, being a civil servant, did not have the duty or responsibility to determine whether the legislature has the right to meet or the validity or legality of any assembly meeting.

Sivakumar's senior lawyer Chan Kok Keong said that they will be filing an appeal against the High Court decision soon.
