The power tussle between PPP president M Kayveas and sacked former Youth chief T Murugiah takes a new twist with party national legal advisor Naran Singh claiming that it is impossible for Murugiah to go to court for legal redress.

kayveas murugiah ppp "How he is going to get the court to review his sacking from the party when Section 18C of the Registrar of Societies Act clearly states that the decision of the party is final and cannot be challenged in any court of law?" he asked.

Naran said the proper procedure is to appeal to Home Minister Hishammuddin Hussein within 30 days from the date of the decision of the Registrar of Societies (ROS) as stipulated under Section 18 of the Registrar of Societies Act.

"I wonder if he (Murugiah) had done so accordingly and if he did not do so then he has insulted the office of the Home Ministry in bypassing this final avenue and going to court," he added.

Naran said he will be representing the party if the case goes to court.

Judicial review order

As for the leave application granted to Murugiah by the High Court on Friday to challenge the ROS decision that his sacking from PPP was valid, Naran said it is an application for only a judicial review order.

High Court Judge Alizatul Khair Osman Khairuddin also granted Murugiah leave to quash the ROS' decision that the party's extraordinary general meeting (EGM) held on May 24 when he was elected as the new president was invalid.

Naran said this does not mean that Murugiah has won the battle as the court has to decide on the merits of the application when the matter goes to the legal avenue.

Murugiah was sacked from the party after he allegedly went against the aspirations of the party’s leadership.

This lead to both Kayveas and Murugiah locking horns for the president's post with the rebel former youth chief forming so-called new branches and introducing radical changes including to the party's uniform.
