A senior lawyer, disbarred by the Bar Council a few years ago, successfully appealed for jail sentences related to his conviction on two criminal breach of trust (CBT) charges to be served

concurrently, instead of consecutively.

Originally, Kow Chee Kang, 54, was jailed five years by the Sessions Court on July 8, last year for misappropriating RM468,000 belonging to a wholesale company, and on a second charge of RM16,000 belonging to building owner Johari Muhamad Yusup.

Both offences were committed at No 41-1, Jalan 2/3A, Pusat Bandar Utama, Off Jalan Ipoh between Dec 11, 2003 and May 25, 2004.

For the first, Kow was jailed three years and fined RM10,000, while for the second offence, two years and a RM6,000 fine. The jail terms were ordered to run consecutively.

At the High Court today, Justice Mohamad Zabidin Mohd Diah allowed Kow's appeal for the sentences to run concurrently and maintained the RM16,000 fine.

While concurring with the lower court in convicting the lawyer on both offences, Mohd Zabidin said however, the sentencing should be concurrent since the offences involved a single transaction.

Kow serves his three-year sentence, beginning today.
