A former Port Klang Authority (PKA) general manager succeeded in her bid to compel PKA to provide the minutes of its board meeting from 1998 to 2008, PKA financial rules, circular and rules governing the implementation of the PKFZ project to facilitate her defence in a civil suit filed by the port authority.

In making the decision in chambers today, High Court deputy registrar Suraya Wati Shawal ordered PKA to provide the documents to Phang Oi Choo within 14 days.    

Phang's counsel Lavinia Kumaraendran told Bernama that Suraya Wati, in granting Phang's application for recovery of the documents, said if PKA failed or refused to comply with the order, all proceedings initiated by the defendant against the plaintiff would be suspended.

NONE On Jan 26, Phang, in her affidavit to support the application, said that without the documents, she could not give directives to her counsels, besides answering the allegations levelled at her by the respondent, to prepare her defence.

Phang said since she was no more PKA general manager from June 2008, she could not access the documents.

PKA, in an originating summons filed on Oct 8, last year, alleged that Phang, its former general manager, had breached her fiduciary, contractual and common law duties to the authority.

It also contended that Phang had failed to exercise due care, diligence and skill in discharging her duties when she was its general manager.

PKA claimed that Phang had failed to comply with Treasury guidelines, failed to ensure that key agreements entered into by PKA contained adequate terms necessary to safeguard PKA's interests, and appointed a quantity surveyor firm which was in a position of conflict of interest due to the firm's association with Kuala Dimensi Sdn Bhd (KDSB), the turnkey developer of the PKFZ project.
