Kelantan state councillor Husam Musa today called for a suit to be filed against the federal government for ceding away the oil-rich maritime boundary areas to Brunei.

"I hope parliamentarians, lawyers, NGOs, private citizens, including those from Sabah and Sarawak, will join me in filing this suit in court," said Husam ( pix ) in a statement emailed to the media.

In the same statement, he also demanded that the prime minister Najib Abdul Razak:

  • husam musa pas annouce contest of number 2 post 250509 02 Reveal to the public all communiques between Putrajaya, Brunei, Sabah, Sarawak and national oil company Petronas pursuant to the ceding of the boundary areas.

  • Report all decisions made by the cabinet about the matter.

  • Convene a royal commission of inquiry to investigate the issue.

    • Failing which he will file a suit against the government to remedy the unilateral decision by the federal authorities.

    "If a reasonable amount of time has passed without any answer to these demands, I urge Malaysians to join me in filing the citizen’s civil suit against the government to obtain a declaration that the ceding of the boundary areas is invalid and goes against the constitution," said Husam

    He added that he deems the decision to cede the boundary areas to Brunei unconstitutional and may have adverse effects on the nation.

    "One of [the adverse effects], is the integrity and position of Petronas as a multinational corporation which had to cancel contracts with other parties. This will encourage the perception that Petronas contracts are unreliable thus undermining its credibility," he said.

    ‘High treason’

    Following a blog posting by former premier Dr Mahathir Mohamad, Wisma Putra on Monday acknowledged that Brunei holds sovereign rights over the two Malaysian oil-concession areas known as Block L and Block M in the South China Sea.

     

    azlan Apparently in March last year, the two governments had signed an agreement to jointly develop these concessions under a plan to resolve outstanding issues between the countries.

    ‘Malaysia's oil concession Blocks L and M, which coincide with Brunei's Blocks J and K, are recognised under the Exchange of Letters as being situated within Brunei's maritime areas...,’ the ministry shockingly revealed in an unsigned statement.

    "Brunei is entitled to exercise sovereign rights under the relevant provisions of the UN Convention on the Law of the Sea 1982," it further added.

    The matter has risen to national prominence and has caused a public outcry , especially in East Malaysia with some quarters labelling the move as ‘high treason’.
