The Kota Bharu Syariah Appeals High Court has allowed the second wife of the Sultan of Kelantan, Elia Suhana Ahmad to visit her husband, Tuanku Ismail Petra, as decided by the Syariah High Court on Feb 4.

The panel of three Syariah Appeals High Court judges, namely Syarie Chief Judge Daud Mohamad, Nik Hashim Nik Abdul Rahman and Wan Hassan Wan Muhamad allowed the visit after studying the affidavits and authority from Elia Suhana, 31, and the Raja Perempuan of Kelantan, Tengku Anis Tengku Abdul Hamid.

Daud said the postponement decision by the Syariah High Court on April 4 was inappropriate as the order had already been issued to the legal wife.

On April 4, the Syariah High Court here decided to postpone the case on Elia Suhana's application for permanent visitation rights on her husband to June 13.

The postponement was decided because the Syariah High Court wanted the application to be heard after the hearing on the application to cancel the filing of the divorce pronouncement by the Sultan of Kelantan on Elia Suhana is decided on May 23.

On March 21, Elia Suhana filed an interlocutory application (application within an application) to cancel the filing of the divorce pronouncement by the Sultan on Elia Suhana filed by Nik Rorhana Wan Abdul Rahman, 60.

The Sultan of Kelantan was alleged to have pronounced the divorce on Elia Suhana, 31, on Feb 12.

On Feb 4, the Kota Bharu Syariah High Court allowed Elia Suhana to visit the Sultan of Kelantan from Saturday until the morning of Monday, every week.

However, Elia Suhana claimed that she was prevented by the three defendants, namely the Raja Perempuan of Kelantan and two of her personal bodyguards to meet her husband and on Feb 21, the court had ordered the Raja Perempuan of Kelantan and two of her personal bodyguards to be present and to show cause.

Elia Suhana was represented by counsel Fakhrul Azman Abu Hassan while Zainul Rijal Abu Bakar represented the Raja Perempuan of Kelantan.
