The Special Court at the Palace of Justice, in Putrajaya is sitting today to hear on the former Sultan of Kelantan Tengku Ismail Petra Sultan Yahya Petra's habeas corpus application.

A hearing on May 10 was postponed due to a lack of quorum.

But there were the required five judges present today including the Chief Justice and two Chief Judges of the High Court.

NONE The panel was led by Chief Justice Zaki Azmi ( right ). The others were the Chief Judge of Malaya Justice Arifin Zakaria, Chief Judge of Sabah and Sarawak, Justice Richard Malanjum, along with two Federal Court judges Justices Zulkefli Ahmad Makinuddin and Mohd Ghazali Mohd Yusoff.

Details of today's proceeding are sketchy as it is being done in camera and the press not allowed in.

The Special Court was established pursuant to Article 182 of the Federal Constitution to hear any action civil or criminal instituted by or against the Yang di-Pertuan Agong or any of the nine Malay Rulers.

It is a requirement by the Special Court that the proceedings are closed, while the judgment based on the majority decision of the court can be reported by the media.

Petition will be heard on Monday

Tengku Ismail's lawyers filed the habeas corpus application earlier in May, against five respondents - the Kelantan police chief, inspector-general of police, director-general of HUSM, director-general of health and the government of Malaysia.

The application was filed to secure his release after being held allegedly against his will at the Hospital Universiti Sains Malaysia in Kubang Kerian.

While details of today's proceeding remains uncertain it is learnt on Monday, the Federal Court has fixed the hearing of two of Tuanku Ismail's petitions which was filed on May 5 and June 22 this year.

It is learnt the two petitions concern the powers of the regent, Tengku Muhammad Faris Petra who now had ascended to the throne with the title of Sultan Muhammad V.

Details of the matter may come to light as the Federal Court hearing will be done in open court.
