A traffic police sergeant was sentenced to 45 months' jail and RM30,000 by the Sessions Court in Kuantan today after he was found guilty on three counts of bribery, involving RM1,500.

Judge Irwan Suainbon handed down the sentence on Abdul Malek Sulaiman, 43, after finding that the defence had failed to raise reasonable doubts against the prosecution case.

On the first count, Abdul Malek, from Taman Kempadang Baru here, was charged with receiving RM500 from one Teoh Ting Keong as an inducement to not take action against his sand lorry for violating the Road Transport Act 1987 and the Road Traffic Rules 1959.

The offence was committed at a cafe of a hotel here at 5.44pm on Nov 15 last year.

For the second and third charge, Abdul Malek, who is with the Pahang police contingent, was charged with receiving the same amount from Teoh, also for the same purpose, at different hotels at 3.39pm on Dec 17 last year and at 12.30pm last Jan 19.

He was sentenced to 15 months' jail and RM10,000 fine on each count to be served consecutively from today.

However, Irwan allowed a stay of the jail sentence, pending an appeal, and imposed bail of RM8,000 in one surety.

In mitigation, Abdul Malek, who was represented by lawyers, Syed Azimal Syed Abu Bakar, Mohamad Saifuldin Ab Rahman and Mohd Rosalman Fithri Salim, said it was his first offence.

11 strokes of rotan for CBT

In the same court, a former finance executive of Koperasi Serbausaha Makmur Berhad (Kosma) was sentenced to three years' jail and 11 strokes of the rotan after he was found guilty of 11 counts of criminal breach of trust.

Mohamad Yusnizam Mohamad, 30, from Kampung Padang here, was charged with committing the offence, involving 11 cheques for about RM260,700, at the cooperative's office at Sri Kuantan Square, Jalan Teluk Sisek here, between December 2007 and March 2008.

He was sentenced to three years’ jail and a stroke of the rotan on each count, to be served concurrently.

However, Irwan allowed a stay of the sentence and ordered Mohamad Yusnizam to be bailed for RM8,000 in one surety.

Deputy public prosecutor Hidayatul Syuhada Shamsudin prosecuted, while lawyers Muhd Hisham Abdul Rahim and Zaharman Zainal Abidin represented Mohamad Yusnizam.
