The high-profile corruption trial of former Selangor menteri besar Dr Mohd Khir Toyo has been postponed to Wednesday.

Shah Alam High Court judge Mohtaruddin Baki said this is to allow the defence time to receive and study documentation on new discoveries submitted at the last minute by the prosecution.

The defence team, led by M Athimulan, applied for the postponement at the start of today's proceedings, after learning of the new development.

However, DPP Abdul Wahab Mohamed, who is leading the prosecution team, objected, arguing that there is no change to the charge. He also said the documents had been sent to the defence, which should receive these today.

"While new developments in a case are not sufficient grounds for postponement, the lack of documentation is," ruled Mohtaruddin in granting the defence application.

The court was also informed that all charges have been dropped against Ditamas director Shamsudin Haryoni, but no reasons were given.

NONE Mohd Khir (left) and Shamsuddin were jointly charged last December under Section 165 of the Penal Code, with alleged bribery in a transaction involving two plots of land in Section 7, Shah Alam.

Mohd Khir was alleged to have bought the properties at an unreasonably low price from Ditamas Sdn Bhd, of which Shamsuddin was a director.

    

In return, Shamsudin and Ditamas were allegedly favoured with contracts worth millions of ringgit when BN administered the state, with Mohd Khir as menteri besar.

The properties at No 8 & 10, Jalan Suasa 7/1 L, Shah Alam were said to have been sold to Mohd Khir at RM3.5 million, though these were valued at RM6.5 million when Ditamas acquired them in 2004.

Shamsuddin also faced an additional charge of abetting Khir, under Section 109 of the Penal Code.
