The Malaysian Bar will hold an emergency general meeting on July 14 to brief members on the recent High Court injunction against the proposed June 23 EGM. Bar Council secretary Kuthubul Zaman Bukhari in a notice faxed to malaysiakini this evening, said that the meeting would also discuss the costs arising out of the recent litigation involving the Bar.

The meeting is scheduled to be held at the Renaissance Hotel Grand Ballroom at 3pm. The EGM has to meet a quorum of 1,820, which is a fifth of the total number of 9,100 members of the Malaysian Bar.

A number of resolutions are expected to be voted on by lawyers attending the meeting, including one on whether the Bar should appeal the court injunction against its June 23rd meeting.

In order for any resolution to be carried out, at least two-thirds of the members present must vote to support it.

On June 22, High Court judge R.K. Nathan granted an injunction preventing the Bar from holding the EGM which was to have discussed a proposed resolution calling for the establishment of a tribunal or royal commission of enquiry to look into allegations against Chief Justice Eusoff Chin.

Nathan granted the injunction on grounds that the allegations against Eusoff was unsubstantiated.

Lawyer K. Raja Segaran had, on June 19, filed a suit against the Malaysian Bar and 11 Bar Council members seeking a declaration from the court that the meeting as well as a circular issued to council members and notice informing lawyers of the EGM were ultra-vires the Legal Profession Act, contemptuous and seditious.

He sought the injunction to prevent the EGM from taking place. In granting the injunction, judge Nathan also ordered the Bar Council to pay Raja Segaran for costs of the court hearing.
