A NGO has lodged a police report against Bank Negara governor Zeti Akhtar Aziz for allegedly "undermining" attorney-general Mohamed Apandi Ali.

Jaringan Melayu Malaysia (JMM) secretary-general Hamdan Mohd Salleh said Zeti should be responsible for revoking the three permissions granted to 1MDB.

"In doing so (revoking the three permissions), Bank Negara had mala fide (bad) intentions to tarnish the attorney-general's good name and undermine him," he told reporters after lodging the report at the Dang Wangi district police headquarters in Kuala Lumpur today.

The Attorney-General's (AG's) Chambers on Tuesday revealed that it decided not to prosecute based on Bank Negara’s investigation into 1MDB under Part 1(4)(b) of the Fifth Schedule of the Exchange Control Act 1953 (ECA).

It was also revealed that Bank Negara had urged the AG's Chambers to review this decision.

Bank Negara last week ordered 1MDB to repatriate US$183 billion in funds after it had revoked the three permissions granted to the company under the ECA for investments abroad.

Hamdan pointed out that the attorney-general had decided that no crime was committed under the ECA.

He added that Bank Negara’s decision to revoke the permissions was also based on the wrong reasons.

'Hidden agenda'

“An offence under the ECA is related to disclosure of false information, not inaccurate or incomplete information,” he said.

Bank Negara had concluded that permissions required under the ECA for 1MDB’s investments abroad were obtained based on inaccurate information or without complete disclosure of material information relevant to the central bank’s assessment of 1MDB’s applications.

However, in revoking the permissions, it was as though Bank Negara was trying to hide its mistake when it approved the applications, said Hamdan.

“Why did they decide to revoke the permissions four to six years after they were granted?

“It seems that there is a hidden agenda behind the governor’s action,” he said.

Asked whether the police will open investigations into the case, Hamdan expressed hope that they would do so within seven days.

“Zeti should not think that she is kebal (invincible). She is also human,” said Hamdan.
