Former Umno Batu Kawan Umno vice-chief Khairuddin Abu Hassan has filed a notice of appeal at the Kuala Lumpur High Court to inform that he would be appealing to the Court of Appeal over the failure to strike out the financial sabotage charge he is facing.

The application was filed by Khairuddin's solicitors from the Law Practice of Rafique at the High Court criminal registry today.

This was confirmed by his lead counsel Mohd Haniff Katri Abdulla.

On April 13, Judicial Commissioner Nordin Hassan dismissed Khairuddin's application after allowing the preliminary objection by DPP Mohd Abazafree Mohd Abbas, saying the court had no jurisdiction to assert that attorney-general Mohamed Apandi Ali did not have the authority to move the charge against Khairuddin.

With this, Khairuddin would still have to stand for the charge of attempting to sabotage the country's banking and financial services.

Nordin said it was the Yang di-Pertuan Agong who appointed the attorney-general, on the advice of the prime minister according to Article 145 of the Federal Constitution, and hence the prerogative of the Agong to appoint is non-justiciable.

Khairuddin and his lawyer Matthias Chang are charged under Section 124L of sabotaging the financial system of the country by lodging reports in five countries namely Switzerland, United States, United Kingdom, Hong Kong and Singapore.
