PKR's Rantau candidate Dr S Streram today filed an election petition at the High Court in Seremban to challenge the Election Commission's decision in announcing the victory of former Negeri Sembilan menteri besar Mohamad Hassan on April 28.

He named Mohamad, returning officer Amino Agos Suyub and the EC as respondents.

In his petition filed by law firm Messrs Haniff Khatri and Co, Streram said he was qualified to be a candidate to contest in the 14th general election for the state seat.

As such, he added, there should be two valid candidates on the nomination day, namely Mohamad and himself.

In his petition, Streram related the incident that took place two days before nomination day, where he picked up the nomination form and paid the deposit to contest.

The PKR candidate, however, was not allowed to enter the nomination centre to file his papers as he did not possess the EC pass, which the commission had promised to give him earlier.

Subsequently, Amino Agos announced that Mohamad won the seat, uncontested. 

Following that, Streram, who is an anaesthetist, lodged two police reports against the EC.

Later, the commission gazetted the Rantau results on May 3.

Streram said the EC had committed an offence under Sections 4(a) and (g), 9(1) and 10(1) of the Election Offences Act 1954 when they prohibited him from contesting.

This, he claimed, had violated his constitutional rights to contest. He forwarded a letter of demand to the EC last month.

Streram is seeking a declaration that Mohamad was not lawfully and legally elected.

He is also asking an order for a by-election to be held for the Rantau state seat.

Earlier this month, Streram filed a misfeasance suit against the EC and Amino Agos.
