The Penang High Court today unsealed the election document, Form 14, for the Tasek Gelugor parliamentary seat.
According to lawyer Rafique Rashid Ali, acting for Bersatu candidate Marzuki Yahya, the forms held by the Election Commission were unsealed at 11am this morning.
“Copies were given to lawyers representing Marzuki and the MP Shabudin Yahaya.
“We have 10 days or so to revert to the court on the next move, as case management is fixed on Jan 14.
“All parties were reminded by the court that they are bound by secrecy under Section 5 of the Election Offences Act 1954 to not reveal anything," he said when contacted by Malaysiakini.
In his election petition, Marzuki claimed that during the number of votes indicated on Form 14 for Tasek Gelugor during the 14th general election was different from what was displayed onscreen at the tallying centre.
The document will now be compared with the version Marzuki's lawyers had previously received.
On Dec 21, Justice Hashim Hamzah ordered the form to be unsealed in the presence of the High Court senior assistant registrar and lawyers.
The Tasek Gelugor parliamentary seat comprises three state constituencies, namely Permatang Berangan, Sungai Dua, and Telok Ayer Tawar.
The Federal Court had ordered a full trial last November for the Tasek Gelugor election petition after allowing Marzuki's appeal.
Marzuki, who is the Bersatu secretary-general and deputy foreign minister, had lost the seat to Shabudin by just 81 votes in the 14th general election.
The former was eventually appointed as a senator, while Shabudin later quit Umno to become an independent.
