The High Court in Kuala Lumpur has dismissed Pekan Umno's application to stay a forfeiture suit against it, pending its appeal at the Court of Appeal.
Judge Mohd Nazlan Mohd Ghazali ruled there were no special circumstances that merited a stay.
He also ruled that the applicant's concern about a third-party claimant being unable to return the monies forfeited was based on conjecture.
Earlier, DPP Mazoah Mohaide argued that there are no third-party claimants as of yet.
Meanwhile, she said the MACC, being part of the government, would be able to return the funds should Pekan Umno succeed in an appeal against the forfeiture.
The MACC is applying to forfeit RM700,000 from Pekan Umno said to be linked to the 1MDB scandal.
DPP Allan Suman Pillai said with the stay application rejected, the next stage will be the hearing for any third party applicants on the monies, fixed on Nov 15.
The court previously set the date after allowing the prosecution’s application to gazette a third-party notice under Section 61(2) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act.
The forfeiture suit is part of 41 applications made by the MACC in June to seize RM270 million, which it believes to be illicit funds from 1MDB.
