Pandikar Amin, 6 others file petitions over Sabah polls

Former Dewan Rakyat speaker Pandikar Amin Mulia and six others have filed election petitions to challenge the outcome of the Sept 26 Sabah state polls.
Free Malaysia Today reported this afternoon that the petitions involve the Sabah state seats of Pintasan, Karambunai, Darau, Sindumin, Petagas and Kukusan.
The online news portal quoted an anonymous source, namely an officer from the Attorney-General’s Chambers (AGC).
“The petition was filed at the Election Court within 21 days from the gazetting of the (Sabah state polls) results on Oct 6,” the AGC officer was quoted as saying.
The news site reported that the AGC will represent the election officer and the Election Commission (EC), who have been named as respondents in the petitions.
Pandikar (photo, above) was a candidate who contested the Pintasan state constituency in a six-cornered fight, but was beaten by Perikatan Nasional (PN)-Bersatu candidate Fairuz Renddan.
The AGC officer was quoted as saying that two petitions were filed for the Sindumin state constituency.
“The first petition was filed by a candidate who was declared as unqualified on the reason that the person was a bankrupt, while the second petition (was filed) by a candidate who was beaten in the six-cornered fight there,” the source said.
Warisan candidate Awang Ahmad Shah won the said state seat.
Among those who filed a petition is Warisan candidate Ahmad Jais Oteng, who was beaten by BN-Umno candidate Yakub Khan with a 16-vote majority in a seven-cornered fight at the Karambunai state seat.
Another who filed a petition is BN-Umno candidate Jumat Idris, who was beaten by Warisan candidate Azhar Matussin with a 562-vote majority in a six-cornered fight for the Darau state seat.
A petition was also filed in relation to the Kukusan state seat, which was won by Warisan candidate Rina Jainal.
FMT reported that Kuching High Court judge Alwi Abdul Wahab will be the election court judge for the petition involving Sindumin, while judge Dean Wayne Daly, who is based in Miri, will preside over the petition for Petagas.
It was reported that for the four other petitions, the court has not set case management dates.
Section 35A of the Election Offences Act 1954 requires that all election petitions be disposed of within six months of filing.
Following the Sept 26 Sabah polls, Gabungan Rakyat Sabah (BN-PN-PBS) swept up a total of 38 seats, while Warisan Plus (Warisan-DAP-PKR-Upko) secured 32 seats. The remaining three seats were won by independent candidates.
