Naza Group chair’s battery case postponed to Sept 20

The wife battery case involving Naza Group chairperson SM Faisal SM Nasimuddin Kamal before the Kuala Lumpur Magistrate's Court has been vacated earlier this morning.

This comes after lead defence counsel, Akberdin Abdul Kader, was unable to attend today’s hearing due to the passing of his sister-in-law.

Defence counsel Jagjit Singh said that Akberdin was meant to cross-examine today’s witnesses.

Magistrate Nadia Othman then set case management for Sept 20.

SM Faisal, who was present today, is charged with intentionally causing injury to then-wife Emilia Hanafi at their home in Desa Sri Hartamas in Brickfields, Kuala Lumpur, between 12.30pm and 4.30pm on Nov 25, 2015.

The charge against SM Faisal was framed under Section 323 of the Penal Code, with Section 326A of the same code providing a maximum penalty of two years in jail or a fine not exceeding RM2,000, or both if found guilty.

According to Free Malaysia Today, fifth prosecution witness Mahmood Riad Mohd Noor testified yesterday that when Emilia lodged a police report against her former husband, she had told him she was strangled and beaten by SM Faisal.

He said the report took place at the Sri Hartamas police station on Nov 23, 2015.

Mahmood Riad later acknowledged that a report was also lodged by SM Faisal later that day.

Back on July 7, the court warned Emilia, 43, not to use the medical certificate as a “ticket” to be absent from proceedings.

Earlier on June 27, Emilia was sent to Kajang Prison to serve a seven-day jail term for failing to comply with a Syariah High Court order on visitation dates for her three children by SM Faisal, 43.
