PAS will analyse the grounds of judgment before deciding whether to appeal against the Election Court's nullification of Perikatan Nasional lawmaker Che Alias Hamid’s victory for the Kemaman parliamentary seat.

"PAS will decide whether or not to appeal after studying the grounds of judgment by the Election Court, based on Section 37 of the Election Offences Act 1954," PAS secretary-general Takiyuddin Hassan told Malaysiakini today.

Yesterday, Kuala Terengganu High Court judge Anselm Charles Fernandis nullified Che Alias' victory of the seat in the last general election, after allowing an election petition by voter Wan Mohamad Hisham Wan Abdul Jalil.

In the event that PN does not file an apex court appeal within 14 days from today, the Election Commission will declare the parliamentary seat vacant, paving the way for a by-election.

In addition, the court also ordered RM30,000 costs to be paid by the respondent (Che Alias) to the petitioner.

Meanwhile, PN Youth chief Ahmad Fadhli Shaari said they respected the court's decision and left it to the coalition's leadership to decide on whether to appeal against the verdict.

"If the party decides to not appeal, there will be a by-election and the taxpayers' money have to be spent to hold the polls.

"Regardless, we vow to defend the Kemaman parliamentary seat again, and hopefully win it with an even bigger majority," he wrote on Facebook.

Should there be a by-election, Fadhli hoped that BN would re-field former Terengganu menteri besar Ahmad Said, who contested for the seat in GE15 and lost to Che Alias.

In GE15, Che Alias wrested Kemaman with a 27,179-vote majority over Ahmad Said, Pakatan Harapan candidate Hasuni Sudin, and Pejuang candidate Rosli Ab Ghani.
