Two-thirds of cases involving politicians given NFA: Azalina

Two-thirds of the investigation papers opened between 2020 and July this year on criminal cases involving politicians have been classified as “no further action” (NFA).

Citing data from the Attorney-General’s Chambers (AGC), Minister in the Prime Minister’s Department (Law and Institutional Reform) Azalina Othman Said said 41 out of 60 such cases have been deemed NFA.

The minister, however, stressed that authorities are empowered to conduct further probes into cases that have been classified as NFA if circumstances change in the future. 

“Unlike civil cases, criminal cases are not subject to any limitation period.

“Therefore, should there be new developments in the future, further investigation and review of these cases may still be carried out,” she said in a parliamentary written reply yesterday.

Azalina said this in response to a question from senator Hussin Ismail, who had requested the statistics and details on mechanisms or guidelines implemented to ensure that the NFA classification is not influenced by political considerations.

In her reply, the minister assured that the AGC thoroughly examines all evidence submitted in the police’s investigation papers without regard to the background of the individual under probe.

“The assessment is made based on facts, evidence, and applicable law, taking into account the principles of integrity, transparency, and prosecutorial independence,” she added.
