I refer to the letter, Violation of constitution is nothing new (June 20) by Arbibi Ashoy. Bfore he becomes "horrified", the writer should think objectively of how the situation may unfold.

The writer should note that constant amendments to the Constitution by Barisan Nasional commanding more than two-thirds majority in Parliament are, quite apart from their merits or demerits, nevertheless constitutional and legal.

That is very different from a deliberate violation of the Constitution by PAS that hasn't yet got the two-thirds to amend and bring the Constitution in line with hudud . That PAS' hudud moves violate the Constitution is already ably explained by Suaram in Hudud contravenes Federal Constitution, says Suaram (June 19).

The question now is whether federal government in KL will want to uphold the Constitution and enforce the law to prevent its violation in the face of PAS' intransigence in challenge of its will to do so.

The federal government may act to block hudud 's enactment considering that if state legislatures do not respect the Constitution as supreme law of the land — if they do not abide by and instead purposely break it — this may set an undesirable precedent to encourage lesser others to likewise do so illegally and unconstitutionally in other future contexts.

PAS Terengganu state legislators have to act responsibly or else they will create a potential situation of public disorder that threatens national security.

It can happen if or when the federal government implements measures to stop Terengganu state legislators from illegally proceeding to pass hudud and PAS' supporters in Terengganu are incited to resist KL, perceived to be frustrating their will, and desire for hudud , as expressed through their state legislators.

Wouldn't this hold the classic potential of a clash and confrontation between federal law enforcers and the PAS supporters?

The Emergency laws and Internal Security Act are specifically designed to address and avert such a potential threat to public order, national security and subversion of constitution.

The above scenarios are therefore not entirely uncontemplatable and remote.
