Referring to the acquittal of a janitor by the Court of Appeal, it seems that the accused was acquitted on technical grounds and not that he did not commit the offence of rape on his daughter.

If so, the acquitted is still guilty of raping his daughter but let free just because the prosecution (as claimed) did not follow the appropriate procedures for obtaining conviction. The defence, in other words, won the case just on technicalities and not on the main issue of contention - whether the accused did or did not rape his daughter. Is this what society desires?

To the defence all is immaterial as long as the accused can be freed. Sad to say, many cases have been won by defence counsel just by 'exploiting' technicalities and in this way justice is denied to the victim of crime.

This is the 'game' of justice we are in - if you cannot defend the accused on the bone of contention, then look for the technical which flaws many young public prosecutors are not aware of!

You will win the case. After all, this is also trademark lawyering.
