Talking about strata titles, our understanding is that according to the Strata Title Act 1985 (Section 8) the proprietor of a completed building capable of being subdivided must apply for subdivision of the building once the proprietor has sold, or agreed to sell, any parcel in such a building.

We further understand that the time frame for application for subdivision is within six months from the commencement date of this section (which is Feb 23, 1990). Upon approval of subdivision and payment of fees by the developer, the Registrar of Titles at the relevant land office shall prepare, register and issue strata titles.

Notwithstanding clear provisions in the Strata Title Act 1985, it is sad to hear of non-compliance by developers/proprietors of high rises in Malaysia. In addition, such deviant proprietors have been getting away for many years without being penalised by the authorities.

One case in point is the SPB Towers along Jalan Batai in Damansara Heights developed by Bangsar Hill Holdings Sdn Bhd - a subsidiary company of Selangor Property Berhad - some 30 years ago. It has yet to apply for subdivision and the issuance of strata titles.

How long more will the individual owners of the apartment units have to wait before their strata titles can be delivered to their hands?
