I refer to your report Police visit Malaysiakini office .

I find it strange that no one has picked up upon the procedural error in the case of the police filing a report against the alleged defamatory malaysiakini article against the police.

In the first instance how can the Royal Malaysian Police wear two hats - first as the complainant and the second of the investigating authority?

Surely this is an issue of conflicted interests and lack of proper checks and balances in accordance with the principle of separation of powers.

If the alleged report (since withdrawn and apology tendered by malaysiakini ) was indeed defamatory, surely the Attorney-General's Chambers or the public prosecutor as representatives of the federal government and ultimately the rakyat, would have been a more appropriate complainant and not the police.
