Thats why we need independent commission to pick judges

The Court of Appeal's majority decision to dismiss R Subashini's appeal is a testimony that the judiciary urgently needs the often spoken establishment of an independent commission for the appointment of our judges.

The judgment given by the dissenting and presiding justice Gopal Sri Ram speaks of a deep intellect and vast experience to distinguish the supremacy of the Federal Constitution vis a vis the Acts of Parliament, without any racial or religious bias. But the other two judges' judgment is tainted with religious bigotry.

Strangely a judge of Sri Ram's stature, caliber and seniority is still deemed unfit for elevation to the Federal Court for reasons left to everyone's guess.

Going beyond the law, is it morally or even religiously right to allow a woman to suffer such an injustice against her or underage children? If one loves a religion, it is his sole business to convert even though he can be selfish enough to disrupt and disturb the existing family harmony thus far enjoyed.

Notwithstanding, he should not impose an authoritarian conversion of others in the family. They should continue to enjoy their own freedom otherwise it breaches the very basic human rights. And no religion preaches this to the best of my knowledge.

We trust the matter will be judiciously adjudicated once the matter is before the Federal Court, which should uphold the right to freedom of worship and religion for all Malaysians.
