I refer to the letter Blacklisted by Ctos - the ultimate crime . Unfairly Blacklisted's anger at Ctos is misdirected. It should be at the financial institution concerned.

All Ctos did was to take publicly available information and aggregate the info in a database. Hence, any bank checking on that particular person will find the summons information. I suggest that Unfairly Blacklisted get a lawyer, show all the proof of payment to the bank, then file a lawsuit at that bank and their lawyers. This because:

i) Subject had repaid all the outstanding amounts and

ii) subject was only overdue on penalty interest of RM358.

I am not a lawyer, but banks have to be made more responsible and accountable. So I suggest that he or she file a suit and ask for compensation and to clear your name as clearly your were not in breach of the loan agreement at the time of the summons irrespective of the bank's policies (the judge or magistrate will usually agree with you here).

The writer should also demand for compensation for damages due to him being listed as a person who doesn't settle his or her debts.

But please don't go barking at Ctos as they have played an important role. Remember that we and our loved ones have deposits in the banks. The banks use our deposits as loans which they can repay us with interest plus the principal.

They have to ensure that whilst they don't lose our money, they also have to make money for their organisation. You wouldn't want the banks to lose all our deposits by giving loans to people who have a history of not repaying loans, would you? I think not.

Hence Ctos plays an invaluable role. So go after the culprit, i.e. the banks. CTOS is a mere public aggregator of public information. I was very surprised when the second finance minister requested a review on whether Ctos had violated the Banking and Financial Institutions Act (Bafia) 1989.

Clearly shows the minister or his advisers are not aware of what Ctos does and were merely playing to the gallery.

The real culprit is either the bank or the person in the mirror. Clean up your records, get a discharge letter. If the bank refuses to give the discharge letter in a timely manner, send a written complaint to Bank Negara. If there is still no action, then seek legal redress.
