The appointment of the CJ must be in accordance with the Constitution, says Joseph ([#1}CJ's appointment unconstitutional[/#], Dec 7).

I would love to know: When do we need to refer to the Constitution? And when don't we need to?

I mean, if we refer to the Constitution on matters relating to the appointment of the CJ, should we not also refer to it on matters such as the right to peaceful assembly, as outlined in Article 10?

Surely, the question of basic rights cannot be less important than the appointment of the CJ?
