On Zambry gets stay order, state in limbo

Kit: To prevent confusion among people as some of the newspapers have misleading headings and information, the fact of the case is that the Court of Appeal (CoA) is just a stay order. Actual decision has not been made.

The CoA decision is a temporary remedy to the KL High Court decision two days ago, which declared Nizar as the rightful menteri besar. It is not a reversal of that decision. The stay of execution merely delays the effect of that decision.

The truth remains that Nizar is the rightful menteri besar as decided by Justice Abdul Aziz, which deliberated in detail all the submissions from both sides. The CoA judge Ramly did not do that. Not yet. He only considered the special circumstances as submitted by Zambry lawyer for a stay order. An actual appeal process, which can take much longer, will deliberate in detail later.

In other words, as long as Zambry does not get a reversal of that High Court decision from any of the superior courts, i.e. CoA and Federal Court, he is found to be illegimate. But because he got the stay order, he will continue to go into the menteri besar office. In the mean time, Nizar, who was declared the rightful menteri besar, is still the rightful menteri besar of Perak, as long as that decision is not reversed.

Frustrated Malaysia: The Sultan of Perak seems to be unkind to the people of Perak and Malaysia. He has disappointed the people of Perak and the nation. However, I find it strange that Malaysians are still dressing their word heavily on the Internet to avoid embarrassing him. I honestly think he is the culprit for this erosion in democracy in Malaysia and no one should be blame but him.

Let's face it he holds the power for justice in this case, not BN or PKR or anyone. It is a shame he is not someone I used to read about. A black day for the Sultans of Malaysia. We should work towards a Republic like Singapore if all the Sultans behave like the Perak, one with no love for the people and the nation.

The wheels of justice seems to be moving at breakneck speed for BN while it is at snail pace when it was not in their interest. When the High Court declared the lawful MB was Nizar, Zambry filed an appeal and it was scheduled to be heard the next day by a one man judge. Why is it so urgent to hear this case while the judiciary is dragging its feet in the trial of the two Pakatan Raykat (PKR) party hoppers who have a corruption trial hanging over their heads?

Surely the trial of the two PKR state assemblyman is of paramount importance because it will ultimately means whether we have a by-election if they are found to be guilty. And that precisely will affect the supposedly majority of BN in the State Assembly.

Millionth Citizen: Maybe a revolution is the only way out for the Perak fiasco. All these serve and volley by both Pakatan and BN in court is shameful to the hilt. It is now the Sultan of Perak that has to be firm.

What a shame BN. When will you ever learn? The rakyat just dont want you anymore. Can't you silly people understand this simple message from the people? Dissolve the assembly immediately. It should be the ‘rakyat's' wish, and not anyone else. Gone are the days of BN.

Barathi Tamil: A sad day indeed to see the arrogance of BN again.They never change. This is what Hindraf's Uthayakumar said in his first day of released from ISA. Look at how arrogant Zambry was when giving a statement. Is this what we call a leader for ‘rakyat'?

It's sad to see politicians are attracted to power and money. Why BN or Umno can't accept a fresh election? Are they afraid they will lose? In fact, some people have said that if there's a fresh election, Zambry will lose his seat. Please, we love this country. Why can't you accept failure in a good manner? It's a sad day for me.

Why can't the Sultan of Perak dissolve the state assembly and let us have a fresh election in Perak. This is getting too painful to see the stupid events unfolding. At least PKR is calling for a fresh election but how come BN only wants to cling to the power they have usurped? How can they think anyone will want to vote for them in the next general election?

Is there any other way out? Can the ‘rakyat' organise themselves to hold a referendum to hold another election? Is there any petition that we can sign for? It's so frustrating to only read the news but one can't do anything about the situation.

If a court declare Zambri was never a legitimate Perak MB, how does Zambry have any standing to appeal against the court ruling? If Zambry can appeal, then can't anybody appeal such as my driver or my maid? The ‘rakyat' elected Nizar. Has that been forgotten in the tit-for-tat circus in Perak?
