Sixty-four year-old joss-stick Liew Chin Nam's is fighting a losing battle as a two-week deadline for him to vacate a railway reserve land in Chemor in Perak ends tomorrow.

The new deadline ends tomorrow (July 15).

And recent events have not been in his favour. His battle to prove that he is a legal tenant of the KTMB land has hit a stumbling block.

No word from MB's office

However, the phone call from Azhar never came and efforts by Parti Sosialis Malaysia K. Kunasekaran to contact Azhar also proved futile. There was also more bad news today when the respondents in an injunction sought by Liew from the High Court failed to turn up in court.

High Court 2 Judge Zainal Adzam Abdul Ghani, however, postponed hearing Liew's application to July 20.

This means that the land office may carry out its threat to demolish Liew's building structures as scheduled tomorrow. If this happens, Liew's court case may be rendered academic.

Abuse of process of law

When this question was posed to Liew's lawyer G. Balasunderam ( below ), he said: "It will be an abuse of the process of law (if they went ahead with the demolition).

"Anyway, let's us not jump the gun and wait for the court's decision on Monday. We had filed for exemplary damages from the Court and let us see the outcome of the case."

"I have also today faxed two letters, one to the land office and the other to RAC urging them not to go ahead with the demolition order until the court decides Liew's fate on Monday," he said.
