Lawyer Karpal Singh thrice referred to articles 63 and 64 of the Perak state constitution on the options available to the sultan in solving the political crisis in the state, the High Court was told today.
RTM reporter Eliani Mazlan, 26, said Karpal also provided copies of two Federal Court decisions to reporters at the press conference in his office on Feb 6.
Even though she could not understand the issue in toto when Karpal cited case laws to explain the options available to the sultan, she said generally the lawyer stressed that the Sultan had no power to interfere in the political affairs of the state.
Cross-examined by defence counsel Jagdeep Singh Deo on how long she had been attached to the RTM newsdesk when she attended the press conference, she said it was her second month.
Eliani agreed that she did not pose any question to Karpal.
She also agreed that Karpal did not force his opinion on the sultan but was just expressing his opinion on the options available to the sultan in handling the crisis.
Karpal, 69, who is also DAP national chairperson, is alleged to have made seditious remarks about the Sultan of Perak at the press conference held in his office, Messrs Karpal Singh & Co, in Jalan Pudu Lama here between noon and 12.30pm on Feb 6.
Do you know which party Karpal is from?
Jagdeep: You did not ask any questions because you were not sure what the issue was all about?
Eliani: Disagree
Jagdeep: If I refer you to the case law decided by the Federal Court which was given to you on that day, can you understand?
Eliani:
I wouldn't know.Jagdeep: It means you don't understand what was mentioned in that press conference?
Eliani: Not sure.
Jagdeep: Do you agree that Karpal was calm during his explanation?
Eliani: Yes
Jagdeep: Did you understand what is the meaning of "ultra vires"?
Eliani: Not Sure.
Jagdeep: What's your understanding of the word?
Eliani: Action beyond what was provided under the law.
Jagdeep:
Did you know which party Karpal was from?Eliani: Don't know.
Jagdeep:
Do you agree that the 10-page transcript tendered in the court yesterday was inaccurate, since some words are missing?Eliani: Agree.
Re-examined by deputy public prosecutor Kamaluddin Md Said, Eliani said she could not understand two case laws cited by Karpal Singh during the press conference even though she could understand the main issue that Karpal was trying to highlight that day.
She also explained that the 37 minutes of video recording of the press conference, which was viewed by court yesterday, was not edited as contended by the defence.
"Actually the visual was not edited. Several 'gaps' in the recording as referred by the defence counsel actually occurred when the cameraman repositioned his camera," she said.
The hearing before Judicial Commissioner Azman Abdullah continues on Tuesday. - Bernama
