Anwar Ibrahim's application for a judicial review to quash a written statement by the prosecution relating to his sodomy case will be mentioned on Sept 2.

High Court (Appelate and Special Powers Division) judge Lau Bee Lan fixed the date in her chambers today after allowing Anwar's application for a postponement of the hearing until his appeal against a High Court order for provision of certain documents demanded by him was heard by the Court of Appeals.

Anwar, a former deputy prime minister and currently the de facto leader of PKR, wants the prosecution to supply the documents deemed favourable to him at least three weeks before the sodomy case is heard.

On June 24, Anwar received a written statement signed by deputy public prosecutor Mohamad Hanafiah Zakaria which stated that there were no facts favouring the defence in the sodomy case.

Anwar had filed the application to quash the prosecution's written statement at the High Court on Aug 3 and had named Mohamad Hanafiah, the public prosecutor and the government of Malaysia as respondents.

Bid to stop prosecution from proceeding

In the application, Anwar had also filed for a mandamus order to compel the prosecution to supply facts favourable to him under Section 51A(1)(c) of the Criminal Procedure Code.

He also sought for an order to prevent the prosecution from proceeding with the sodomy case until these facts were made available to him.

Anwar, 62, is accused of sodomising his former aide Mohd Saiful Bukhari Azlan, 24, at a condominium in Bukit Damansara here on June 26 last year.

The court had initially set July 1 for the hearing but postponed the date to facilitate the applications filed by Anwar.
