The Kuala Lumpur High Court's Appellate and Special Powers division has today postponed to tomorrow in delivering its judgment on opposition leader Anwar Ibrahim's leave application to bar seven prosecutors from participating in his sodomy trial.

Justice Alizatul Khair Osman Kamaruddin met lawyer Sivarasa Rasiah and senior federal counsel See Mee Chun in her chambers to announce the postponement.

bershi 1blackmalaysia pc 050509 sivarasa rasiah Sivarasa, when met outside the court explained that Justice Alizatul Khair needed more time to deliberate on the arguments forwarded by both parties at the last session as it had not been advanced before.

"Following this, Justice Alizatul will deliver her decision tomorrow at 2.30pm", Sivarasa, who is also Subang MP, said.

Journalists and members of the public had packed the court room in anticipation of the verdict and also to hear another matter involving National Union of Bank Employees case. However, Anwar was not present in court.

Anwar, 62, who is also Permatang Pauh MP had on Aug 11, filed an application to disqualify all seven prosecutors from his on going sodomy trial.

The application was based on Anwar's contention that Attorney-General Abdul Gani Patail was "biased and/or prejudiced in its prosecution against him", citing his "black-eye" incident and a task force investigation formed by the police to investigate the matter.

Anwar, named the seven prosecutors he wanted to disqualify from his trial.

They are Solicitor-General 1 Idrus Harun who is leading the prosecution team on behalf of the AG, Solicitor-General II Mohd Yusof Zainal Abiden, prosecution officers Nordin Hassan, Mohamad Hanafiah Zakaria, Wong Chiang Kiat, Shamsul Sulaiman and Noorin Badaruddin.

Sivarasa had on Sept 3 submitted there is a real danger of bias should the court allow the seven prosecutors to proceed in conducting the sodomy trial on Anwar.

lingam tape panel meeting 031007 abdul gani patail He claimed Anwar has evidence that Attorney General Abdul Gani Patail (right) , had fabricated evidence in Anwar's black eye incident in 1998 and that the team of prosecutors in this sodomy trial were aware of the matter and had not done anything, including not lodging a police report over the matter.

Explaining the black-eye incident in a 30-page letter it involved investigating officer Mat Zain Ibrahim and showed Abdul Gani's role in trying to hide the fact.

However, See submitted that the Attorney-General's actions were non-justifiable and hence cannot be challenged.

Furthermore, See submitted that Anwar had also not followed the Rules of the High Court in filing this application as no decision had yet to be made on the opposition leader's criminal trial.

Anwar has claimed trial in sodomising his former aide Mohd Saiful Bukhari Azlan, 24, at a condominium in Bukit Damansara on June 26 last year.
