The application by Sister in Islam (SIS) for revision of Kartika Sari Dewi's sentence has been turned down by the assistant registrar of the Kuantan Syariah High Court.

All documents pertaining to the revision and the court fees were also returned to the lawyer representing SIS in Pahang.

SIS had filed for a revision and a stay of execution in the controversial case two weeks ago following the controversial sentencing of Kartika.

NONE Kartika, a part-time model was sentenced to a fine of RM5,000 and six strokes of rotan from the Kuantan Syariah High Court after pleading guilty to drinking alcohol on July 11, 2009.

Kartika ( right ) has refused to appeal against the sentence and has repeatedly said she was willing to be whipped.

Unprecedented action

In an immediate reaction, SIS described the action by the registrar as "unprecedented" since all applications filed and duly paid must be accepted and heard by the court.

"Further, the court has no right to filter any applications.

"Rejecting the applications at the filing stage tantamount to denying the right of a party to be heard, and in this case, denying SIS the right to be heard," said SIS in a statement.

SIS also questioned the Sept 28 decision to uphold Kartika's sentence, which was made during a departmental meeting between Pahang Syariah chief judge and the state Religious Department (JAIP).

According to SIS, section 168 of the Pahang Syariah Criminal Procedure Enactment 2002 states that only the Syariah Court of Appeal has the power to review a Syariah High Court decision, not a departmental meeting.
