For the second time in a fortnight, the Kuala Lumpur High Court has decided to defer judgement, this time to Oct 22, on Puchong MP Gobind Singh Deo's challenge on the 12 months suspension order and the withholding of his remuneration by the Parliament.

Judicial Commissioner Mohd Ariff Md Yusof said he is postponing his verdict today to seek further clarification on the point of whether parliament was right to also suspend the Puchong MP's remuneration.

Mohd Ariff said both parties had alluded to but had not given due emphasis on the matter when submission was made the last time.

Following this, he wants both parties namely senior lawyer Karpal Singh for Gobind and senior federal counsel Azizah Nawawi and Amarjeet Singh to provide written submission on the matter.

This relates to Section 32 and 33 of the Houses of Parliament (Privileges and Powers) Act 1952.

He also wanted their written submissions to include the position of the Common Law (British law) on this issue.

"I have here a case law from a Sarawak matter where it says it is wrong to suspend the remuneration of an elected representative. Is this right? I want both parties to submit on the matter," said Mohd Ariff.

Gobind was handed a suspension order by the Speaker that will keep him out of Parliament for 12 months beginning March 16.

This suspension order also bars him from receiving any allowance and other benefits as an elected representative.

Suspended for linking murder to PM

altantuya and son 050309 The first term Puchong MP was suspended from parliament after he had linked the then Deputy Prime Minister Najib Abdul Razak with the murder of Mongolian Altantuya Shaariibuu (right) , and called him a "murderer" in the process.

He challenged the suspension order and has filed a lawsuit against the government, Dewan Rakyat speaker Pandikar Amin Mulia, the House secretary and Minister in the Prime Minister's Department Mohd Nazri Abdul Aziz over this.

The Puchong MP is seeking to lift the suspension order and have the declaration that is unconstitutional, declared null and void.

He also wants the letter notifying him of his suspension signed by Parliament secretary Roosmee Hamzah and the orders contained in the letter to be declared unenforceable in law.

Gobind is further seeking a declaration to reinstate all remuneration and other benefits that are constitutionally granted to a parliamentarian under Article 64 of the federal constitution.
